    USITC institutes Section 337 investigation into DRAM devices on Netlist complaint

    The U.S. International Trade Commission instituted an investigation under section 337 of the Tariff Act of 1930 on a complaint filed August 11, 2026, as supplemented August 25, 2026, by Netlist, Inc. of Irvine, California, alleging that certain dynamic random access memory (DRAM) devices, products containing the same, and components thereof infringe claims of U.S. Patent No. 10,025,731, U.S. Patent No. 10,217,523, U.S. Patent No. 12,373,366 and U.S. Patent No. 12,675,407. The complaint also alleges that an industry in the United States exists or is in the process of being established. Netlist requests a limited exclusion order and cease and desist orders after the investigation.

    USITC declines to review ALJ order terminating semiconductor devices investigation

    The U.S. International Trade Commission determined not to review an initial determination, Order No. 77, of the presiding administrative law judge granting a joint motion to terminate the investigation in its entirety based on settlement and to limit service of the settlement agreement. The investigation concerns certain foreign-fabricated semiconductor devices, products containing the same, and components thereof. The notice does not state an effective date or any action for importers.

Maintenance Center, Terra Drone Corporation, ACSL Ltd., Mitsubishi Nuclear Fuel Co., Ltd., Japan Nuclear Fuel Limited, Fujitsu Network Solutions Limited, Hitachi Advanced Systems Corporation, Komatsu Industries Corporation, Komatsu NTC Ltd., OKI Electric Industry Co., Ltd., OKI Com-Echoes Co., Ltd., OKI Circuit Technology Co., Ltd., OKI Nextech Co., Ltd., OKI Engineering Co., Ltd., YDK Technologies Co., Ltd., Nihon Denji Sokki Co., Ltd., Howa Machinery, Ltd., Hosoya Pyro-Engineering Co., Ltd. and The Fujikura Parachute Co., Ltd. Exporters may not use general licences or registration-based export credentials for these entities, and single-item licence applications must include a risk assessment report and a written commitment not to use the items for any purpose that helps enhance Japan's military strength.

    Canada amends Export Control List to add five controls on quantum computing and advanced semiconductors

    Global Affairs Canada states in Notice to exporters No. 1129 that an Order Amending the Export Control List, approved on May 31, 2024, adds five new controls under Item 5506 covering quantum computers able to process quantum information in 34 or more physical qubits, circuits and devices specially designed for them, CryoCMOS integrated circuits operating at 4.5 Kelvin or below, technology for semiconductor devices using GAAFET structures, equipment for isotropic and anisotropic dry etching, and advanced Scanning Electron Microscope equipment. As of July 20, 2024, a permit is required to export these items from Canada, except to the United States.

    Why it matters: From July 20, 2024, exporters of the five items added under Item 5506 need a permit to ship them from Canada, except to the United States.
