    CBSA: DFO export and possession licences required for American eel elvers from March 1, 2025

    CBSA states that, effective March 1, 2025, an export licence and a possession licence are required for American eel elvers (Anguilla rostrata), with no exemptions from the export licence and limited exemptions from the possession licence, such as commercial transporters and airport personnel. Elvers are a restricted good under section 5 of the Reporting of Exported Goods Regulations, and shipments for export must be reported electronically to the CBSA, with the licence number, DFO shipment identification number, scientific name, common name and life stage on the export declaration.

    Global Affairs Canada issues Notice to Exporters No. 1159 on cloud storage of controlled technology

    Global Affairs Canada's Notice to Exporters No. 1159 states that storing controlled technology in the cloud can constitute a transfer under the Export and Import Permits Act, requiring an export permit, where there is a reasonable possibility that a person outside Canada could examine the technology. GAC interprets a transfer as occurring when controlled technology is sent from Canada and stored abroad in a way that creates more than a remote possibility of foreign access, including through decryption keys or access rights. Safeguards consistent with the Canadian Centre for Cyber Security's Guidance on cloud security assessment and authorization will generally mean no permit is required.

    Canada amends Export Control List to add five controls on quantum computing and advanced semiconductors

    Global Affairs Canada states in Notice to exporters No. 1129 that an Order Amending the Export Control List, approved on May 31, 2024, adds five new controls under Item 5506 covering quantum computers able to process quantum information in 34 or more physical qubits, circuits and devices specially designed for them, CryoCMOS integrated circuits operating at 4.5 Kelvin or below, technology for semiconductor devices using GAAFET structures, equipment for isotropic and anisotropic dry etching, and advanced Scanning Electron Microscope equipment. As of July 20, 2024, a permit is required to export these items from Canada, except to the United States.

    Global Affairs Canada sets import permit rules for restricted handguns under Notice to Importers No. 1106

    Global Affairs Canada states in Notice to Importers No. 1106, issued under the Export and Import Permits Act, that importation of restricted handguns into Canada is limited to police, military, movie and theatrical purposes; training, competing or coaching in an Olympic or Paralympic handgun shooting discipline; and re-importation of lawfully registered handguns by individuals holding a possession and acquisition licence (PAL) and registration certificate. Import permits are required for the first two categories, and applications for other purposes will normally be denied. Notice to Importers No. 1090 is no longer in place, and Notice 1106 remains in place until further notice.

    Canada amends GEP-41 to bar dual-use exports for long-range rockets and UAVs

    Global Affairs Canada states in Notice to Exporters No. 194 that, effective September 1, 2023, General Export Permit No. 41 (GEP-41) was amended to add a category to the "unauthorized goods and technology" list under paragraph 3(2)(e), prohibiting its use for the export or transfer of goods or technology intended for the development, production or use of rocket systems or unmanned aerial vehicles with a range of 300 km or greater. GEP-41 continues to cover most goods and technology in Group 1 and ECL item 5504 to the 32 eligible destinations listed in the permit, which include Australia, Japan, South Korea, Türkiye, the United Kingdom and the United States.

    Global Affairs Canada amends Export Permits Regulations for military, strategic goods and certain forest products

    Global Affairs Canada states that the amended Export Permits Regulations, which set the information export permit applicants must provide for Strategic and Military Goods and Technology and Certain Forest Products, came into force on June 1, 2023 and were published in the Canada Gazette on June 21, 2023. The amendments cover Export Control List Groups 1-4, 6, 7, 9 and Items 5101 to 5103, 5400, 5401 and 5501-5505, create separate sections for strategic and military goods and for certain forest products, and add email addresses for applicants and consignees plus a fax number "if any".

    Global Affairs Canada sets allocation and return rules for CETA high-sugar product export quota

    Global Affairs Canada's Notice to Importers and Exporters Serial No. 1093 sets out the administration of the CETA origin quota for High-Sugar Containing Products, defined as goods in Item 5205 on the Export Control List, namely Table A.1 of Annex 5-A of CETA between Canada and the EU and its Member States, and remains in effect until further notice. Allocations go 75% in Pool 1 on an equal share basis to eligible sugar refiners that apply by the prescribed deadline and 25% in Pool 2 first-come, first-served to eligible food processors and sugar refiners.

    Global Affairs Canada requires individual import permits for restricted handguns from August 19, 2022

    Global Affairs Canada states in Notice to Importers No. 1090 that, from August 19, 2022 until the proposed amendments to the Firearms Act under Bill C-21 come into force, imports of restricted handguns into Canada require an individual import permit. Restricted handguns are controlled by paragraph 70(1) of the Import Control List, and a permit is not required for antique firearms as defined in section 84(1) of the Criminal Code or as prescribed in the Regulations Prescribing Antique Firearms.

    Canada amends Import Control List to add one toxic chemical and three chemical families

    Global Affairs Canada states in Notice to importers No. 1087 that an Order amending the Import Control List was approved on June 24, 2022, adding one toxic chemical and three families of toxic chemicals recently added to Schedule 1A of the Chemical Weapons Convention Schedule, and addressing editorial issues raised by the Standing Joint Committee for the Scrutiny of Regulations. Import permits are now required to import these chemicals into Canada. Specific details are published in the Canada Gazette Part II, and importers should also be aware of related obligations under the Chemical Weapons Convention Implementation Act.

    Canada stops new export and brokering permits for controlled goods to Russia

    Global Affairs Canada states in Notice to Importers and Exporters Serial 1071 that, effective immediately, Canada will stop issuing new permits for the export and brokering of controlled goods and technology to Russia, and that valid permits held by exporters for such exports or brokering prior to February 24, 2022 are immediately cancelled. Only permits and applications related to specific end-uses such as medical supply and humanitarian needs may be considered for exception, on a case-by-case basis. Global Affairs Canada says it will continue to monitor the situation and may reassess the decision.

    Canada sets 2022 TRQ rules for peanut butter exports to the United States under ECL item 5201

    Global Affairs Canada's Notice to Exporters Serial No. 1063, dated November 1, 2021, replaces Notice to Exporters No. 199 of September 30, 2016 and sets out the administration of the tariff rate quota for exports of peanut butter to the United States under U.S. WTO commitments, covering peanut butter classified under tariff item No. 2008.11.10 for export to the U.S. and U.S. HTS item 2008.11.05, with only goods that are a product of Canada eligible to enter the U.S. under Canada's country-specific reserve.

    Global Affairs Canada sets August 15 deadline for brokers to move to New EICS

    Global Affairs Canada states in Notice to Importers/Exporters Serial No. 1058 that Legacy EICS will be decommissioned on August 15, 2021, at 11:59pm ET, and that brokers must obtain new individual sign-in credentials and begin using New EICS before that time to avoid interruptions to their access to the permit system. Company PKI certificates used for Legacy EICS will no longer be valid as of that date and are replaced by individual user log-in credentials and a new web user interface.

    Canada suspends new export and brokering permits for controlled goods to Belarus

    Global Affairs Canada states in Notice to Importers and Exporters Serial No. 1033 that, effective immediately, Canada temporarily suspends the issuance of all new permits for the export and brokering of controlled goods and technology to Belarus. Permits issued before November 9, 2020 remain valid, and exporters may continue to export against those permits during their period of validity. Global Affairs Canada says it will continue to monitor the situation and may reassess the decision.

    Canada tightens export permit scrutiny for Export Control List items to Hong Kong

    Global Affairs Canada states in Notice to Exporters No. 1003 that, effective July 3, 2020, Canada treats exports of sensitive goods to Hong Kong the same as those destined for China and will not permit the export of sensitive military items to Hong Kong. GAC will closely scrutinize all export permit applications for items to Hong Kong and deny permits not in line with Canada's domestic and international legal obligations, foreign policy or security interests. The notice says GAC may reassess the decision in light of changes on the ground.

    Global Affairs Canada notice advises brokers that Canada's brokering controls take effect September 1, 2019

    Global Affairs Canada's Notice to brokers No. 216 advises that Canada's brokering controls under the amended Export and Import Permits Act are in force as of September 1, 2019, set out in the Brokering Control List, the Brokering Permit Regulations, the Regulations Specifying Activities that Do Not Constitute Brokering and General Brokering Permit No. 1. The Brokering Control List covers all items in Export Control List Group 2 (Munitions List) and Group 9 (Arms Trade Treaty items), plus other Export Control List items likely to be used to produce or develop a weapon of mass destruction.

    Canada issues General Export Permit No. 47 for Arms Trade Treaty items to the United States

    Global Affairs Canada states in Notice to Exporters No. 217 that the Minister of Foreign Affairs has issued General Export Permit No. 47, which allows residents of Canada to export to the United States all goods in Group 9 of the Export Control List and certain firearms and ammunition referred to in items 2-1 and 2-3 of the Guide to Canada's Export Controls, without an individual permit application. Prohibited ammunition, prohibited devices, prohibited firearms and prohibited weapons as defined in subsection 84(1) of the Criminal Code remain ineligible and still require individual export permits, as do goods controlled under ECL items 2-2.a. and 2-4.a.

    Global Affairs Canada opens 10,261,000 kg of sugar-containing products export quota to the U.S.

    Global Affairs Canada states that, due to exceptional circumstances, a portion of the sugar-containing products (SCP) export quota to the United States is available for utilization by Canadian residents on a first-come, first-served basis until the quantity is used or September 30, 2019, whichever occurs first, and that as of June 24, 2019 the amount available is 10,261,000 kg. The quota covers only SCPs that are "product of Canada" under item 5203 of the Export Control List, classified under subheadings 1701.91.54, 1704.90.74, 1806.20.75, 1806.20.95, 1806.90.55, 1901.90.56, 2101.12.54, 2101.20.54, 2106.90.78 and 2106.90.95 of the Harmonized Tariff Schedule of the United States (1999).

    Global Affairs Canada sets CETA origin quota rules for high-sugar exports to the EU

    Global Affairs Canada's Notice to Exporters Serial No. 214 sets out the administration of the 30,000 metric tonne CETA origin quota for high-sugar containing products exported from Canada to the European Union and its Member States, covering products with 65 per cent or more by net weight of added cane or beet sugar of subheadings 1701.91 through 1701.99 refined in Canada. The quota year runs January 1 to December 31, Pool 1 takes 90 percent for eligible Canadian sugar refiners and Pool 2 takes 10 percent on a first-come, first-served basis, with Pool 1 applications due November 15 and unutilized quota returnable by July 1.

The Notice invites applicants to apply for a share of the peanut butter for export to the United States, with a deadline of November 15, 2016 for the 2017 peanut butter export year.     Global Affairs Canada's archived Notice to Exporters Serial No. 199, dated September 30, 2016, sets out the administration of Canada's 14,500,000 kilogram export quota for peanut butter destined for the United States under item 5201 of Canada's Export Control List, covering goods of tariff item 2008.11.10, with the quota year running January 1 to December 31. The notice states that an export permit is required for every shipment of peanut butter covered by it, that allocation applications on Form EXT1685-1 are due no later than November 15 immediately preceding the quota year, and that allocation holders may return quota by August 1.
