    CIT certifies importer class in IEEPA tariff refund suit

    The U.S. Court of International Trade certified a class of importers who paid tariffs imposed under the International Emergency Economic Powers Act between Feb. 1, 2025, and Feb. 19, 2026, excluding those who filed separate lawsuits, in a slip order issued Thursday. The court set an Oct. 22 deadline for proposed scheduling of additional filings and a closed conference for Oct. 13, and said certification is intended to lead to liquidation or reliquidation of entries and refunds to importers of record.

    First Solar files TOPCon patent infringement lawsuit against JA Solar and American Panel Solutions

    First Solar filed a lawsuit in U.S. district court against JA Solar and American Panel Solutions alleging infringement of U.S. Patent No. 9,130,074, which covers methods of manufacturing TOPCon silicon solar cells. First Solar said it is also pursuing TOPCon patent lawsuits against Canadian Solar, Jinko Solar, T1 Energy and Trina Solar, and it voluntarily terminated a Section 337 investigation at the International Trade Commission last month in favor of patent infringement lawsuits.

    Commerce corrects notice on China butt-weld pipe fittings covered merchandise ruling

    Commerce published a correction to its August 28, 2026 notice, 91 FR 55518, stating that the CIT's final judgment was not in harmony with Commerce's covered merchandise inquiry determination on certain carbon steel butt-weld pipe fittings from China. Commerce amended the determination to find that products cut to length and formed into the rough shape of butt-weld pipe fittings in China are "unfinished" fittings covered by the scope of the Order, and that when further processed in Vietnam they remain subject to the antidumping order on butt-weld pipe fittings from China. The correction adds clear notice that liquidation of entries of these unfinished fittings will be retroactively suspended.

    Commerce amends LWRPT dumping margins from Mexico after CIT remand in Consol. Court No. 23-00091

    Commerce is amending the final results of the 2020-2021 antidumping duty administrative review of light-walled rectangular pipe and tube from Mexico, applicable September 24, 2026, after the CIT's September 14, 2026 final judgment in Maquilacero S.A. de C.V. and Tecnicas de Fluidos S.A. de C.V. and Perfiles LM, S.A. de C.V. v. United States, Consol. Court No. 23-00091, Slip Op. 26-111, sustained Commerce's second remand results and was not in harmony with the final results. The amended margins apply to Maquilacero/TEFLU, reviewed as a single collapsed entity, and to non-selected companies Perfiles L.M., S.A. de C.V. and Productos Laminados de Monterrey S.A. de C.V.

    Commerce amends welded line pipe order from Korea after CIT remand ruling

    Commerce states that, applicable September 25, 2026, it is amending the final determination and the antidumping duty order on welded line pipe from the Republic of Korea, covering the period October 1, 2013 through September 30, 2014, after the U.S. Court of International Trade sustained Commerce's fourth remand redetermination in Stupp Corp. v. United States, Court No. 15-00334, Slip Op. 26-113 (September 15, 2026). The amendment changes the estimated weighted-average dumping margin assigned to SeAH Steel Corporation and to all other producers and exporters. The notice does not state the revised margin.

    Commerce amends 2021-2022 AD review of utility scale wind towers from Korea after CIT ruling

    Commerce states that the CIT's September 4, 2026 final judgment in Wind Tower Trade Coalition v. United States, Court No. 24-00070, Slip Op. 26-104, is not in harmony with its final results of the 2021-2022 antidumping duty administrative review of utility scale wind towers from Korea, and that it is amending those final results for the dumping margin assigned to Dongkuk S&C Co., Ltd. The amended final results are applicable September 14, 2026. The original final results were published at 89 FR 16544 and corrected at 89 FR 22372. The notice does not state the amended margin.
