    CBSA releases January 1, 2025 Departmental Consolidation of the Customs Tariff

    CBSA states in Customs Notice 24-39 that the January 1, 2025 Departmental Consolidation of the Customs Tariff (T2025) is now available on its website in different format files. The 2025 Tariff reflects scheduled duty rate reductions under individual Free Trade Agreements and the substitution of certain tariff classification pre-ambles and tariff classification numbers in chapters 3, 28, 29, 84 and 85. Changes are marked by a change bar in the PDF version, by the number 1 in the change column of the Access files, and are not marked in the HTML version; concordance tables are also provided.

    CBSA amends Customs Tariff to add CPUKT treatment for the United Kingdom, Channel Islands and Isle of Man

    The Canada Border Services Agency states in Customs Notice 26-22 that the CPTPP enters into force for the United Kingdom on September 1, 2026, so eligible goods from the United Kingdom imported into Canada are entitled to the Comprehensive and Progressive United Kingdom Tariff (CPUKT) tariff treatment, Code 35, as of September 1, 2026. The T2026-2 Customs Tariff adds the United Kingdom, the Channel Islands and Isle of Man to the list of countries for CPUKT treatment and sets the applicable duty rates for tariff items in Chapters 1 to 99.

The notice states that over-access tariffs on CPTPP-originating beef and veal were fully eliminated on January 1, 2023, and that such goods meeting CPTPP rules of origin are now duty-free.

    Global Affairs Canada sets allocation and return rules for CETA high-sugar product export quota

    Global Affairs Canada's Notice to Importers and Exporters Serial No. 1093 sets out the administration of the CETA origin quota for High-Sugar Containing Products, defined as goods in Item 5205 on the Export Control List, namely Table A.1 of Annex 5-A of CETA between Canada and the EU and its Member States, and remains in effect until further notice. Allocations go 75% in Pool 1 on an equal share basis to eligible sugar refiners that apply by the prescribed deadline and 25% in Pool 2 first-come, first-served to eligible food processors and sugar refiners.

    Global Affairs Canada sets WTO sugar-containing products export allocation policy for U.S. shipments

    Global Affairs Canada's Notice to Importers and Exporters Serial No. 1091 sets out the policies and practices for administering the WTO sugar-containing products (SCP) tariff-rate quota for exports to the United States under subparagraph 2(b) of Article 3.A.5. of Annex 3-A of Chapter 3 of CUSMA, pursuant to the Export and Import Permits Act. For 2022, existing allocation holders receive an allocation equal to their 2021-2022 utilization pro-rated to 99% of the total quantity, with a minimum allocation of 197,500 kg; from 2023-2024 onward, allocations equal the previous year's utilization as adjusted for penalties.

    Global Affairs Canada clarifies import permit rules for milk protein substances

    Global Affairs Canada states that imports of milk protein substances (MPS) with a milk protein content of 85% or more by weight, calculated on the dry matter, that do not originate in a NAFTA country, an EU country or other CETA beneficiary, Chile, Costa Rica or Israel are subject to import controls under Canada's Export Import Permit Act, and that only products qualifying as originating products under the concerned trade agreement are exempt from the import permit requirement. Goods shipped via a third country must meet Article 14 (Transport through a third country) to qualify; otherwise an import permit is required.

    Global Affairs Canada states that the 2019-2020 tariff rate quotas for wheat, barley, wheat products and barley products covered by Items 161 to 191 of the Import Control List become accessible on August 1, 2019, administered on a first-come, first-served basis.     Global Affairs Canada states that the 2018-2019 Wheat Products tariff rate quota will be filled as of 11:59 p.m. local time on October 19, 2018, and the within access commitment tariff items will be closed at that time.
